Please read these Terms of Service ("Terms") carefully before using the Safar Guide mobile application (the "Service") operated by Safar Guide LLC ("us", "we", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. The Service
Safar Guide provides immersive audio tours and related location-based content for historical and religious sites. The Service is designed to be used while walking or traveling through specific locations.
Safety Warning: When using the Service, especially the audio tours, you must remain aware of your surroundings at all times. Do not use the Service in a manner that distracts you from traffic, pedestrians, uneven terrain, or other potential hazards. We are not liable for any injuries, accidents, or property damage that occur while using our Service.
2. Accounts
You do not need to create an account to use basic features of the Service. However, an account may be required to sync purchases across devices. If you choose to create an account via email OTP verification, you are responsible for maintaining the security of your email account. You agree to notify us immediately of any unauthorized use of your account.
3. In-App Purchases and Payments
Our Service offers premium content (e.g., specific audio tours) for purchase through standard in-app purchase mechanisms provided by Apple (App Store) or Google (Google Play Store).
Billing: All billing and payment transactions are handled entirely by Apple or Google. We do not process or store your credit card or payment information.
Refunds: Because payments are processed by Apple and Google, all refund requests must be directed to them in accordance with their respective refund policies. We cannot directly issue refunds for in-app purchases.
4. Intellectual Property
The Service and its original content (including, but not limited to, audio recordings, text, maps, graphics, and logos), features, and functionality are and will remain the exclusive property of Safar Guide LLC and its licensors.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not:
Download, copy, or rip the audio content for use outside the app.
Reproduce, distribute, modify, create derivative works of, publicly display, or publicly perform any of our content without express written consent.
5. User-Generated Content and Feedback
If you submit feedback, suggestions, reviews, or other content ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable license to use, reproduce, modify, and publish that Feedback for any purpose without compensation to you.
6. Third-Party Services
Our Service utilizes third-party tools, including Mapbox for map rendering and tracking SDKs like PostHog and Airbridge. Your use of the Service is also subject to the data collection and usage practices as described in our Privacy Policy.
7. Disclaimers
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
We make no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, or completeness of the historical, geographical, or religious information provided in the audio tours. The content is for informational and educational purposes only.
8. Limitation of Liability
In no event shall Safar Guide LLC, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; and (iii) unauthorized access, use or alteration of your transmissions or content.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
